Hi All

Here are the pdf files for the Land Grant Petition for John Livingston, son of Daniel Livingston a native of Scotland. Daniel came to the USA for the last french war before 1798 as a member of the Montgomery Highlanders. If someone wants to put the pieces together for the rest that would be great and explain it to the rest of us. I am terrible at deciphering these old documents.
Ok I have found that there were other petitions for other sons too. I have the documents saved, but will not post them unless someone requests them. Other sons of Daniel were Abraham, Alexander, Daniel, David, Duncan, Silas and Simeon.

Ok.
One more document to go that I have found. Opening the PDF files is easy, but scrolling through the jpg files is a pain. If you right click on the other images and select to save them to your computer that likely is easier. Open them in an image software and they will be much easier to scroll through. Also if the images are too large to be left on because of space restrictions I can remove them after a week or so. So best to save them for yourself or they may be gone.

Hi Barry,

I had not seen that document stating that Daniel Livingston Sr. served in Montgomery's Highlanders during the 1750's French Campaign, though I had looked at the families land petitions some time ago. There is other info indicating that served in the French and Indian Wars with the Fraser's Highlanders. Perhaps he served in both. Bit of a mystery. Later as a loyalist I see it states in a couple of old land petitions tha Daniel served in a British regiment apparently under General Burgoyne in 1777 and also saw it stated that he there at the surrender. Not sure that part is true as there is not information he was taken prisoner by the Americans at Saratoga. I would think his eldest son John would have included that with all the other detailed info he included his own later petitions. Both the British Army and loyalist American regiments fought in the British New York Campaign which ended a the Battle of Saratoga in 1777 and a disastrous defeat for the British and their Loyalist under General Burgoyne. Many Loyalists escaped from the Battle before it ended which was lucky for them as they would have been treated more harshly than the Britiish regulars. This will also be of help when searching for his earliest land petition and land grant in the 1760's before the American Revolution. I read the book some years ago and dont think I noticed MOntgomery's Highlander mentioned but there it is in an original document. Great stuff. I think the book I read was by Edwin Livingston a descendant and I think he was one of ones whom stated that Daniel served with Fraser Highlanders. I checked the 1762 Muster Roll and several Livingstons were listed but there was no Daniel. There is a Donald I think on one of the muster roll lists of Frasers Highlanders. Interesting that one old document you found mentions his service during the French Campaign with Montgomery's Highlanders. Other info suggests Frasers Highlanders. Could he has served in both regiments during the French and Indian Wars. Definitely want to check this lead out. Thanks again for this info.

THe Montgomery's Highlanders were disbanded in December of 1763 and a number of the officers and Enlisted men were given the option of remaining in America and offered land grants. Daniel's grant was apparently in Vermont which in the 1760's was claimed to be part of New York. There was feud with New Hampshire over Vermont so I am not certain which States actually would have copies of the original land documents regarding Daniel's earliest grant while he was in America. There may be British military records pertaining to Daniel Livingston receving a land grant around 1763 or 1764 in what became Vermont which may be in the British Archives. I am not certain where the information that he served in the 1750's with Fraser's Highlander originally came from but it looks like the document you found from the 1790's in Upper Canada clearly states that served with Montgomery Highlanders which makes sense to me. They were both highland regiments that contained highland livingstons. Very interesting. That document by Alexander Campbell Justice of the Peace in May of 1798 from Elizabethtown, Upper Canada may have been accompanied with Daniel Livingstons original land petition which I have seen some time ago and didnt notice the reference to his having served with Montgomery HIghlanders. The letter which certified that Daniel Sr. served with the Montgomery Highlanders is not Daniels petition to the Crown which should also contain detailed info on his history if found that let me know as I would like to compare the Alexander Campbell document with Daniel Seniors land petition in Upper Canada. It should also be dated 1798. Perhaps youve already copied that and did not see it.

Hi Barry,

What is interesting is that the family history is of Daniel Livingston having served with Frasers Highlanders in the French and Indian Wars but the Justice of Peace in that document in Upper Canada from the 1790's at the time Daniel is petitioning for land verifying Daniel's military service to Great Britain states that he served with Montgomery's Highlanders in the French Campaign which took place during the 1750's and early 1760's. Daniel himself you notice in his petition only mentions he served for 7 yrs in the 70th? regiment of foot while in New York and residing under the Command of General Burgoyne at the time of the American Revolution. I had assumed that the tale of Daniel serving with Frasers Highlander early on in the late1750's and early 1760's was taken from one of the petition related documents from Upper Canada but the Justice of Peace in Daniel's documents is saying that he actually in the 1750's is in one of the other highland regiments Montgomery's Highlanders that was created in the late 1750's. I will check the book written by Edwin Livingston on Daniel and his family but cant remember seeing any reference of a document in Daniel's original UPper Canada records stating that he served in the French and Indian Wars with MOntgomery's Highlanders. I check the only surviving Muster roll of Frasers Highland from about 1762 when they were disbanded and saw I think four Livingstons none of whom was named Daniel. Montgomery Highlanders were actually were in the Province of New York during the French and Indian Wars and some of their officers and enlisted ment were granted land in New York or Vermont apparently after the regiment was disbanded so I am curious if Daniel was in Montgomerys Highlanders rather than Frasers Highlanders even though the family tradition seems to be that he served in Frasers Highlanders. I am curious though if there is some early 18th century source info on Daniel being in Frasers Highlanders. Odd though that his in petition papers which included that verification of his military service to receive a loyalist land grant that does not state he served in Frasers Highlanders. I guess some will argue that the Justice of Peace was misinformed but he likely got the info from Daniel himself or that he miscopied it. Dont know one way or another. In any event I am going to follow up on this lead at some point. Its weird I just sort of saw this discrepancy I must admit I never noticed before, not focusing on this Livingston family too much. Glad I had chance to look through these documents. Thanks again for taking the time to locate them.
